Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SwingInsight (“SwingInsight,” “we,” “us”), an AI-assisted swing-analysis platform that turns baseball and softball sensor and video data into development reports and training plans. SwingInsight is operated by Swing Science Hitting Lab Inc., doing business as Swing Science Technologies, an Illinois corporation at 2425 W Lawrence Ave, Chicago, IL 60625. By creating an account, uploading data, or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

Who may use SwingInsight

You must be able to form a binding contract to hold an account. Accounts for athletes under 18 must be created and managed by a parent, guardian, or a coaching organization acting with parental authorization. A minor may not create an independent account. If you use SwingInsight on behalf of a facility, coaching organization, or another person, you represent that you are authorized to do so and to accept these Terms for them.

Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use. You are responsible for the accuracy of the information you enter, and for having the rights and permissions needed to upload it.

What SwingInsight is — and is not

SwingInsight analyzes data you provide and produces reports, metrics, drill recommendations, and training plans. These outputs are informational aids for coaches, athletes, and families. They are not professional coaching, medical, physical-therapy, or nutritional advice, and they are not a diagnosis. SwingInsight does not guarantee any particular performance, improvement, recruiting, or health outcome. You remain responsible for the coaching, training, and health decisions you make.

Your content and data

You retain ownership of the data, sensor exports, video, and account information you upload (“Your Content”). You grant SwingInsight a limited, non-exclusive license to host, process, analyze, and display Your Content solely to provide and improve the service to you, as described in the Privacy Policy. We do not sell Your Content. Athlete data is visible to the athlete, their linked parent or guardian, and the coaches in their organization, as configured in the product.

You represent that you have the right to upload Your Content, including any third-party sensor exports and any video containing other people, and that doing so does not violate any law or any other person’s privacy or intellectual-property rights. For video or data featuring a minor, you represent that you are the parent or guardian or are authorized by them.

Athletes, minors, and parental consent

A large share of athletes on SwingInsight are minors, including children under 13. We process a minor’s information only under an account created and controlled by a parent, guardian, or authorized coaching organization. A parent or guardian may review, correct, export, or request deletion of their child’s information at any time (see the Privacy Policy). We do not use minors’ information for behavioral advertising or sell it. Facilities and organizations using SwingInsight are responsible for obtaining the parental consents required by COPPA and equivalent laws for the athletes they enroll.

Third-party sensors and marks

SwingInsight works with data exported from third-party systems (for example HitTrax, Blast Motion, K-Vest, Rapsodo, Diamond Kinetics, and TrackMan). Those names and marks belong to their respective owners; SwingInsight is not affiliated with, endorsed by, or sponsored by them, and your use of their hardware or software is governed by their own terms. You are responsible for having the right to export and upload data from those systems.

AI-generated analysis

Reports, drill recommendations, and training plans are generated in part by automated and AI systems and may contain errors, omissions, or misinterpretations of the underlying data. Treat them as a starting point for a qualified coach’s judgment, not a substitute for it. We may change, improve, or retrain these systems over time.

Training, health, and assumption of risk

Baseball and softball training carry inherent risk of injury. SwingInsight’s drills, training plans, and strength recommendations are general suggestions, not individualized medical or physical-therapy guidance. Consult a qualified physician before beginning or changing any training or conditioning program, especially for a minor or anyone with a medical condition or prior injury. You (and, for a minor, their parent or guardian) assume the risks of any training performed based on SwingInsight outputs. Stop and seek medical attention if an athlete experiences pain or injury.

Subscriptions and billing

Paid plans and their limits are shown at checkout. Billing is handled by a third-party payment processor; we do not store full card numbers. Paid plans renew automatically for the same term until cancelled. You may cancel anytime from your account settings; access continues through the end of the paid period, and, except where required by law, fees already paid are non-refundable. Prices and plan limits may change on a going-forward basis with notice.

Intellectual property

SwingInsight owns the platform — its software, models, designs, benchmarks, and content — and all related intellectual-property rights, excluding Your Content. These Terms grant you a limited, revocable, non-transferable right to use the service; they do not transfer any ownership in the platform to you.

Availability

We work to keep SwingInsight reliable but provide it “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We may modify, suspend, or discontinue features.

Limitation of liability

To the maximum extent permitted by law, SwingInsight is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or data. Our total aggregate liability for any claim relating to the service is limited to the amount you paid SwingInsight in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to defend, indemnify, and hold harmless SwingInsight from claims arising out of your breach of these Terms, your unlawful or unauthorized use of the service, or your uploading of content (including a minor’s data or likeness) without the rights or consents required. This does not apply to an athlete or family acting solely as an authorized end user.

Termination

You may stop using SwingInsight at any time and cancel from your settings. We may suspend or terminate accounts that violate these Terms, that abuse the platform, or that we are legally required to suspend, with notice where reasonable. After termination we respond to data export and deletion requests as described in the Privacy Policy and retain records only as long as legally required.

Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflicts-of-law principles. Disputes will be resolved in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction there. Nothing here prevents you from filing complaints with regulators.

Changes

We may revise these Terms from time to time. Material changes will be posted here with a new “Last updated” date and, where required, communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
